CANAJOHARIE, N.Y. -- The Village of Canajoharie is moving forward with a lawsuit over Beech-Nut's plans to relocate over protest from some business and community leaders.

An attorney for the village filed the Article 78 petition on Friday, calling for a number of the agreements between Beech-Nut/Hero Group and local governments to be declared "invalid and null and void."

The Village of Canajoharie is moving forward with a lawsuit over Beech-Nut's plans to relocate over protest from some business and community leaders. Our Mark Repasky has the details.
Construction on the new site in Florida began in June, but the village is asking a judge to halt construction. The petition names a number of local and state government entities, including the Florida town planning board and the county industrial development agency.

The village claims the environmental impact process did not take into account the impact on the Village of Canajoharie when Beech-Nut relocates its manufacturing.

During a village meeting earlier this month, several residents spoke out against the lawsuit. Many said it could give a bad impression to companies looking to come to the area.

Village officials said they are looking out for the best interest of taxpayers who still have to foot the bill for water and sewer upgrades for the Beech-Nut plant.
